Terms of service
These terms apply to orders placed through chittera.com. By placing an order you agree to them. If you do not agree with them, please do not order.
Who you are dealing with
This store is operated by Chittera ("we", "us"). You can reach us at nixon.dindial@chittera.com, and that is the fastest way to resolve anything on this page.
Ordering
You must be old enough to enter a contract in your jurisdiction to order.
Your order is an offer to buy. A contract forms when we email you to confirm dispatch — not when you place the order, and not when you receive an order-received acknowledgement. Until then we may decline an order, and we will refund you in full if we do.
We may decline an order where the item is out of stock, where we cannot ship to your address, where a price or description was published in error, or where we reasonably suspect fraud.
Pricing and currency
Prices are in Australian dollars (AUD) and include tax where tax applies. Shipping is calculated at checkout and shown before you pay.
If a price is listed incorrectly we will contact you before dispatch, and you can confirm at the corrected price or cancel for a full refund. We will not quietly charge you an amount you did not agree to.
If your account is not held in AUD, your card issuer may apply its own conversion or foreign-transaction fee. That fee is theirs and we do not receive it.
The product
Chittera is one product in two sizes: a roasted, milled cricket powder, sold as a food.
It contains cricket (Acheta domesticus), and is not suitable for anyone with a crustacean or shellfish allergy. Please read the ingredient and allergen information on the product page and on the pouch before consuming.
It is a food, not a therapeutic good. We make no claim that it treats, prevents or cures anything. Nutrition figures describe the composition of the product as tested, and nothing more. If you have a medical condition, are pregnant or breastfeeding, or are unsure whether a food suits you, speak to a qualified health professional — we cannot advise you on that.
We photograph the product honestly, but screens vary and the colour of a milled agricultural ingredient shifts a little between batches. Minor variation of that kind is not a fault.
Shipping
Where we ship, what it costs and how long it takes are set out in our Shipping Policy, which forms part of these terms.
Returns
Our Refund and Returns Policy forms part of these terms and sets out your options for change of mind, and for goods that arrive faulty, damaged, incorrect or not as described.
Your rights under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded. Where any part of these terms conflicts with such a right, that right prevails and the conflicting part does not apply.
Our liability
Subject to the section above, and to the extent the law allows:
- our total liability for any claim connected with an order is limited to replacing the goods or refunding what you paid for them, at our election;
- we are not liable for indirect or consequential loss, including lost profits, lost opportunity or wasted expenditure;
- we are not liable for a failure to perform caused by something outside our reasonable control.
We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to limit.
Using this website
You may not interfere with the site, attempt to gain unauthorised access to it, scrape it at a volume that degrades it for others, or use it to break the law.
The text, photography, logo and design of this site belong to us or our licensors. You may not reproduce them commercially without written permission. Linking to us is welcome.
Accounts
If you create an account, keep your password to yourself and tell us promptly if you think it has been compromised. You are responsible for activity under your account until you do.
Privacy
How we handle your personal information is set out in our Privacy Policy.
Changes to these terms
We may update these terms. The version that applies to your order is the one published when you placed it, so a later change cannot retroactively alter a purchase you have already made.
Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia, and the courts of Western Australia have non-exclusive jurisdiction. This does not deprive you of the protection of mandatory consumer law that applies where you live.
General
If any clause is found unenforceable, the rest continue to apply. A delay in enforcing a term is not a waiver of it. These terms, together with the policies they refer to, are the whole agreement between us about your order.
